General restrictions on use
JW-Tube hereby grants you permission to access and use the Website and the Services, subject to the following express conditions, and you agree that your failure to adhere to any of these conditions shall constitute a breach of these Terms on your part:
You agree not to distribute any part of or parts of the Website, including but not limited to any User Submissions (as defined below), in any medium without JW-Tube's prior written authorisation;
you agree not to alter or modify any part of the Website or any of the Services (including but not limited to the JW-Tube Player and its related technologies);
you agree not to access User Submissions (defined below) or other content made available on the Website (including JW-Tube Content, as defined below) through any technology or means other than the video playback pages of the Website itself, the JW-Tube Player, or such other means as JW-Tube may explicitly designate for this purpose;
you agree not to (or attempt to) circumvent, disable or otherwise interfere with any security related features of the Website or features that prevent or restrict use or copying of any User Submissions or JW-Tube Content or enforce limitations on use of the Website or the content accessible on the Website;
you agree not to use the Website or any Services (including the JW-Tube Player) for any commercial use, without the prior written authorisation of JW-Tube. Prohibited commercial uses shall include, without limitation:
The resale of access to the Website or any of the Services (such as the JW-Tube Player) on another website for the primary purpose of gaining advertising or subscription revenue; and the redistribution of the Services (including any User Submissions accessible through such Services) for the primary purpose of generating revenue from a substantially similar or comparable business enterprise to that carried on by JW-Tube, but shall not include uploading an original video to JW-Tube, maintaining an original channel on the Website in order to promote a business or artistic enterprise, and any use that is expressly authorised by JW-Tube in writing; if you use the JW-Tube Player on your website, you must include a prominent link back to the Website on the pages containing the JW-Tube Player and you may not modify the JW-Tube Player in any way;
You agree not to use or launch any automated system (including, without limitation, any robot, spider or offline reader) that accesses the Website in a manner that sends more request messages to the JW-Tube servers in a given period of time than a human can reasonably produce in the same period by using a publicly available, standard (i.e. not modified) web browser;
You agree not to collect or harvest any information of the Website or any Service (and agree that this shall be deemed to include JW-Tube account names);
You agree not to use the Website and the Services (including the comments and email features in the Website) for the solicitation of business in the course of trade or in connection with a commercial enterprise;
You agree not to solicit, for commercial purposes, any users of the Website with respect to their User Submissions; and
You agree not to access User Videos (as defined below) for any reason other than your personal, non-commercial use solely as intended through and permitted by the normal functionality of the Services, and solely for Streaming. "Streaming" means a contemporaneous digital transmission of the material by JW-Tube via the Internet to a user operated Internet enabled device in such a manner that the data is intended for real-time viewing and not intended to be downloaded (either permanently or temporarily), copied, stored, or redistributed by the user.
As part of this continuing innovation, you acknowledge and agree that JW-Tube may stop (permanently or temporarily) providing the Services (or any features within the Services) to you or to users generally at JW-Tube's sole discretion, without prior notice to you. You may stop using the Services at any time. You do not need to specifically inform JW-Tube when you stop using the Services.
You agree that you are solely responsible for (and that JW-Tube has no responsibility to you or to any third party for) any breach of your obligations under the Terms and for the consequences (including any loss or damage which JW-Tube may suffer) of any such breach.
Copyright policy
JW-Tube's copyright policy, JW-Tube will terminate user access to the Website if a user has been determined to be a repeat infringer. A repeat infringer is a user who has been notified of infringing activity more than twice.
What is copyright? Copyright is a form of protection provided for original works of authorship, including literary, dramatic, musical, graphic and audiovisual creations. "Copyright" literally means the right to copy, but has come to mean that body of exclusive rights granted by law to copyright owners for protection of their work.
What is copyright infringement? Copyright infringement occurs when a copyrighted work is reproduced, distributed, performed, publicly displayed or made into a derivative work without the permission of the copyright owner.
As a general matter, we at JW-Tube respect the rights of artists and creators, and hope you will work with us to keep our community a creative, legal and positive experience for everyone, including artists and creators.
How To Make Sure Your Video Does Not Infringe Someone Else's Copyrights
The way to ensure that your video doesn't infringe someone else's copyright is to use your skills and imagination to create something completely original. It could be as simple as taping some of your friends fooling around or as complicated as filming your own short movie with a script, actors and the whole works. If it's all yours, you never have to worry about the copyright you own it.
Be sure that all components of your video are your original creation even the audio portion. For example, if you use an audio track of a sound recording owned by a record label without that record label's permission, your video may be infringing the copyrights of others and may be subject to removal.
JW-Tube content on the Website
JW-Tube Content may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purpose whatsoever without the prior written consent of JW-Tube, or JW-Tube's licensors. JW-Tube reserves all rights not expressly granted in and to the JW-Tube Content.

The Services may include hyperlinks to other web sites that are not owned or controlled by JW-Tube. JW-Tube has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites.
You acknowledge and agree that JW-Tube is not responsible for the availability of any such external sites or resources.
You acknowledge and agree that JW-Tube is not liable for any loss or damage which may be incurred by you as a result of the availability of those external sites or resources, or as a result of any reliance placed by you on the completeness, accuracy or existence of any advertising, products or other materials on, or available from, such web sites or resources.
JW-Tube encourages you to be aware when you leave the JW-Tube website and to read the terms and conditions and privacy policy of each other website that you visit.
